‘Law’ said Mr Justice Windeyer of the High Court of Australia, ‘marches with science, but to the rear, and limping a little’. Nowhere is this limping more apparent than in respect of the attempts to keep up with medical science. The media is full of reports of the use of fetal ova to create new life, of the transplant of animal parts into human bodies, of tests involving the consumption of radioactive materials by human subjects. The law's response to these (...) problems has been notable most often by its absence. To some extent, the failure of the law to come to grips with developments is not entirely its own fault. Sometimes the advances made possible by science can only be forseen by those with a scientific background. At other times, however, the law fails by not being flexible enough to be able to create new categories of legal obligations. It tries instead to pigeon-hole radically new ideas within centuries-old categorisations. As anyone who has had experience with packing a large number of outsized objects into a too small suitcase will tell you, squeezing things into inappropriately shaped containers takes time. This is one of the problems apparent in the doctrine of consent; the area of law which attempts to regulate the provision of medical services by a practitioner to a patient. (shrink)

ABSTRACTResistance to austerity in Ireland has until recently been largely muted. In 2013 domestic water charges were introduced and throughout 2014 a series of protests against the charges emerged, culminating in over 90 separate marches on November 1. In this paper we examine the discourses which are produced and circulated by politicians and the mainstream media about this protest movement, and offer a brief insight into the contemporary Irish context of austerity and crisis. We analyse the role of the phrase (...) ‘sinister fringe’ as a discursive device, and unpick the ways in which it has been used to explain the water charges protests to the Irish public. Our conclusions speak to the currency of the protest paradigm as a means of understanding news media reporting of protest. Ultimately we raise concerns regarding the effects of this dominant frame on deliberative democracy. (shrink)

ABSTRACTUsing qualitative content analysis, informed by a Critical Discourse Analysis approach, this article examines the production, content and reception of print and online media discourses concerning the 2017 ‘Welfare Cheats, Cheat Us All’ campaign in the Republic of Ireland. Our article is situated in the context of recent debates concerning the media’s role in articulating ‘disgust’ discourses focused on ‘welfare fraud’, poverty and unemployment. Central to these processes is the social construction of those who are deemed to be the ‘deserving (...) poor’ or the ‘undeserving poor’. Our corpus includes records of in-house debate within the Department of Social Protection; the campaign’s documentation; print media and on-line media coverage of the campaign. The article’s findings demonstrate the ways in which welfare ‘fraud’ is mis-represented by the state and media. It also evidences ways in which such hegemonic discourses can be challenged in traditional and ‘new’ media settings. (shrink)

Understanding spoken words involves a rapid mapping from speech to conceptual representations. One distributed feature-based conceptual account assumes that the statistical characteristics of concepts’ features—the number of concepts they occur in and likelihood of co-occurrence —determine conceptual activation. To test these claims, we investigated the role of distinctiveness/sharedness and correlational strength in speech-to-meaning mapping, using a lexical decision task and computational simulations. Responses were faster for concepts with higher sharedness, suggesting that shared features are facilitatory in tasks like lexical decision (...) that require access to them. Correlational strength facilitated responses for slower participants, suggesting a time-sensitive co-occurrence-driven settling mechanism. The computational simulation showed similar effects, with early effects of shared features and later effects of correlational strength. These results support a general-to-specific account of conceptual processing, whereby early activation of shared features is followed by the gradual emergence of a specific target representation. Extant semantic theories for languages containing vague expressions violate intuition by delivering the same verdict on two principles of classical propositional logic: the law of noncontradiction and the law of excluded middle. Supervaluational treatments render both valid; many-Valued treatments, Neither. The core of this paper presents a natural deduction system, Sound and complete with respect to a 'mixed' semantics which validates the law of noncontradiction but not the law of excluded middle.

Whenever some form of beneficent killing--for example, voluntary euthanasia--is advocated, the proposal is greeted with a flood of slippery-slope arguments warning of the dangers of a Nazi-style slide into genocide. This paper is an attempt systematically to evaluate arguments of this kind. Although there are slippery-slope arguments that are sound and convincing, typical formulations of the Nazi-invoking argument are found to be seriously deficient both in logical rigour and in the social history and psychology required as a scholarly underpinning. As (...) an antidote, an attempt is made both to identify some of the likely causes of genocide and to isolate some of the more modest but legitimate fears that lie behind slippery-slope arguments of this kind. At least since the seminal work of the (US) National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research in the 1970s, a fundamental distinction between research and practice has underwritten both conceptual work in research ethics and regulations governing research involving human subjects. Notwithstanding its undoubted historical importance, I believe the distinction is problematic because it misrepresents clinical inquiry. In this essay, I aim to clarify the character of clinical inquiry by identifying crucial contextual constraints on (...) justification constitutive of clinical science. This analysis shows that, from an epistemological point of view, clinical research and clinical practice are not sharply distinct but intimately intertwined. This result is important in its own right—an enriched understanding of the epistemology of clinical research is valuable in and of itself. But this result is also important because it has profound implications for the ethics of human subjects research. (shrink)

I aim to show how and why some definitions can be benignly circular. According to Lloyd Humberstone, a definition that is analytically circular need not be inferentially circular and so might serve to illuminate the application-conditions for a concept. I begin by tidying up some problems with Humberstone's account. I then show that circular definitions of a kind commonly thought to be benign have inferentially circular truth-conditions and so are malign by Humberstone's test. But his test is too demanding. The (...) inferences we actually use to establish the applicability of, e.g., colour concepts are designed to establish warranted assertability and not truth. Understood thus, dispositional analyses are not inferentially circular. (shrink)

Although this note is prompted by the recent exchange between Gellner [2], [3] and Needham [4], I shall ignore the issues raised by Gellner's specification for an ideal language. I am concerned here only with Needham's statement that ‘biology is one matter and descent is quite another, of a different order’ which, it will be remembered, Gellner treats as Needham's first error. I write under a sense of obligation, for I discussed this matter with Gellner in 1955 while he was (...) preparing his first article and my arguments then were phrased similarly to those advanced by Needham. It appears that I did not make myself clear to Gellner and I shall try again. I do not wish to attack or defend either protagonist; each is quite able to look after himself. Therefore I propose neither to examine where they have misunderstood each other, nor to discuss the difference between kinship and descent, but simply to state the connexion, as I see it, between physical and social kinship. In The Face of Emotions, which was Carroll Izard’s first major attempt at elaborating his differential emotions theory, he stated that the book “presents a theoretical framework for the study of emotions and their role in personality and interpersonal processes.” Yet, over the years, his contribution to personality theory has generally been overshadowed by the attention focused on his views on facial expressions and the structure of emotions. This article will begin with a brief overview of the DET perspective on (...) personality development. Then, it will examine how the DET framework can be used to organize recent findings from three lines of research on adult personality. It will conclude with suggestions for future research as well as some personal recollections. (shrink)

The paper discusses the critical importance of interdependence and team development for the devel opment of human values, humane organizations, and sustainable earth management. The paper accords priority to the cultivation and nurturance of this spirit over TQM, reengineering, strategic management and the like. While not denying the practical need for hierarchy, specialization and discipline, the paper argues that it is the one-sided emphasis on such features which has aggravated fragmentation in organizations, militating against interdependent teamwork.

In the Spring of 1944, an informal discussion took place in Cambridge between Mr. R. S. Whipple, Professor Allan Ferguson and Mr. F. H. C. Butler, concerning the formation of a national Society for the History of Science. This is the opening sentence of the inaugural issue of the Bulletin of the British Society for the History of Science, the Society's first official publication. Butler himself was the author of this outline account of the subsequent approach to the Royal Society, (...) the parallel moves to establish a National Committee of the International Academy of the History of Science, the formation of a provisional committee to prepare a draft constitution for a national society, and the proceedings of the first Annual General Meeting in May 1947. Whipple had been in Cambridge to discuss his offer to present his collection of old scientific instruments to the University and the possible foundation of a new museum, and Butler, as Secretary of the History of Science Committee in Cambridge, was the chief mover in both this development and an initiative coupled with it to establish a department of the history of science. Amyloid-beta peptide plaque in the brain is the primary diagnostic criterion of Alzheimer's disease . The physiological role of Abeta are poorly understood. We have previously determined an Abeta interacting domain in the promoters of AD-associated genes . This AbetaID interacts in a DNA sequence-specific manner with Abeta. We now demonstrate novel Abeta activity as a possible transcription factor. Herein, we detected Abeta-chromatin interaction in cell culture by ChIP assay. We observed that human neuroblastoma cells treated with FITC conjugated Abeta1-40 (...) localized Abeta to the nucleus in the presence of H2O2-mediated oxidative stress. Furthermore, primary rat fetal cerebrocortical cultures were transfected with APP and BACE1 promoter-luciferase fusions, and rat PC12 cultures were transfected with polymorphic APP promoter-CAT fusion clones. Transfected cells were treated with different Abeta peptides and/or H2O2. Abeta treatment of cell cultures produced a DNA sequence-specific response in cells transfected with polymorphic APP clones. Our results suggest the Abeta peptide may regulate its own production through feedback on its precursor protein and BACE1, leading to amyloidogenesis in AD. (shrink)

In his recent paper Gellner singles me out for special comment and some reply is called for. He attributes to me several propositions which he says I made in my note on ‘Physical and social kinship’ in this journal, and he then refutes them. Reading his paper I cannot avoid thinking that he exaggerates the differences between us, thereby apparently strengthening his argument. Some substantial differences there are, but others are fictional. A line-by-line analysis of what he says about me (...) in his paper might be amusing but would be of only ephemeral interest. What follows is a discussion, in three parts, of the African concept of ubuntu and related issues. In the first part of the discussion J.A.I. Bewaji assesses an essay by W.M.J. van Binsbergen on Ubuntu and the Globalisation of Southern African Thought and Society (2001). In the second part Bewaji reviews M.B. Ramose's African Philosophy through Ubuntu (2002). And in the third part Ramose responds to both Bewaji and Van Binsbergen. Although Ramose disagrees with some of Bewaji's comments and interpretations (...) – especially with regard to the thesis on which ubuntu is, according to the former, founded (i.e. “that ontology proper is a rheology”) – both Bewaji and Ramose agree that Van Binsbergen's critique of ubuntu philosophy, and specifically of Ramose's explication thereof, is untenable.
